Terms of Service

These terms are an agreement between you and FERFORTINI LLC, a Florida limited liability company doing business as Rent Whats Yours ("we", "us"), covering your use of rentwhatsyours.com. By creating an account, listing an item, or booking a rental, you agree to them. Questions? Email me@ferfortini.com.
1. What we are
Rent Whats Yours is a marketplace operated by FERFORTINI LLC that connects neighbors who own items ("Owners") with neighbors who want to rent them ("Renters"). We are not a party to the rental itself, we do not own, inspect, or insure listed items, and we are not an employer of Owners who provide done-for-you services.
2. Accounts
- You must be at least 18 and able to enter a binding contract.
- You must give accurate information, keep your login secure, and are responsible for activity on your account.
- Renters may be required to verify a government ID before their first pickup.
- We may suspend or close accounts that break these terms, create risk, or involve fraud.
3. Owner responsibilities
- You own the item or have the right to rent it, and it is safe, working, and as described.
- AI-suggested titles and prices are suggestions only. You are responsible for reviewing everything before publishing.
- You are responsible for any licenses, permits, and taxes that apply to your rentals and services.
- For done-for-you rentals, you perform the job yourself, safely and in a workmanlike way.
4. Renter responsibilities
- Use items only for their intended purpose, following any instructions from the Owner and the manufacturer.
- Return items on time, clean, and in the condition received, less normal wear.
- You are responsible for loss, theft, and verified damage that happens during your rental period.
- No sub-renting, lending to others, or taking items outside the agreed area without the Owner's permission.
5. Payments, fees and card holds
- Renters pay the rental price plus a service fee and a damage protection fee at checkout. Payments are processed by Stripe.
- At pickup, a temporary preauthorization hold (typically $100, $200–250 or $500 depending on the item) is placed on the card saved at checkout. You authorize us to place this hold and to capture all or part of it for verified damage, loss or late return.
- Owners receive their earnings through Stripe after a completed return, minus our fees. Owners must complete Stripe's payout setup to be paid.
- Fees are shown before you pay and are non-refundable except as described below.
6. Cancellations and refunds
If an Owner cancels or the item is not available as described at pickup, the Renter receives a full refund. Other cancellations are handled according to the cancellation terms shown at booking.
7. Damage and disputes
Owners and Renters take time-stamped photos at pickup and return. If an Owner reports damage, we review those photos and any other evidence. When damage is verified, the cost is drawn first from the card hold; any amount beyond the hold may be charged to the Renter's saved card. The damage protection fee is not insurance and does not cover intentional damage, misuse, theft by the Renter, or prohibited use. Our decision on a dispute is final within the marketplace, without limiting any legal rights you have.
8. Prohibited items and conduct
- No firearms, weapons, ammunition, explosives, drugs, alcohol, tobacco, adult content, recalled or unsafe items, or anything illegal to rent where you live.
- No harassment, discrimination, fraud, fake listings, or arranging payment off the platform to avoid fees.
Our photo checks automatically block some of these, but you remain responsible for what you list.
9. Assumption of risk
Using tools, vehicles, and equipment carries risk of injury and property damage. Renters use items at their own risk and should wear appropriate safety gear. Golf carts and similar vehicles must be driven only where legal and by licensed adults.
10. Limitation of liability
To the fullest extent allowed by law, the platform is provided "as is". We are not liable for the condition of items, the conduct of users, or any indirect, incidental, or consequential damages. Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim.
11. Indemnity
You agree to cover us for claims, losses, and costs arising from your listings, rentals, services, or breach of these terms.
12. Governing law and disputes with us
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Most issues can be solved by emailing me@ferfortini.com. Any remaining dispute with us will be resolved by individual binding arbitration seated in Florida, not class actions, except for small-claims matters, which may be brought in a Florida court.
13. Changes
We may update these terms. We'll post the new date here and, for material changes, notify you before they take effect.
